Terms of Service

End User License Agreement for BioLLM, OpenCure, and all associated services operated by Stormy IT Services LLC.

This End User License Agreement ("Agreement" or "EULA") is a legally binding contract between you ("User," "you," or "your") and Stormy IT Services LLC, a Florida limited liability company doing business as Ankythera AI ("Company," "we," "us," or "our"). By accessing or using BioLLM, OpenCure, the BioLLM API, the BioLLM mobile application, or any related service (collectively, the "Service"), you acknowledge that you have read, understood, and agree to be bound by this Agreement.

If you do not agree to these terms, do not use the Service.


1. Definitions

2. Eligibility

You must be at least 18 years of age to use the Service. By using the Service, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into this Agreement. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to this Agreement.

3. License Grant

Subject to your compliance with this Agreement, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for personal, educational, and research purposes. This license does not include the right to:

  1. Modify, copy, distribute, or create derivative works of the Service, its source code, model weights, or brain simulation parameters;
  2. Reverse engineer, decompile, or disassemble any part of the Service;
  3. Sublicense, sell, resell, or commercially exploit the Service or its outputs without prior written consent;
  4. Use the Service to develop a competing product or service;
  5. Remove, alter, or obscure any proprietary notices, labels, or marks on the Service.

4. User Content & Inputs

You retain ownership of any Content you submit to the Service. By submitting Content, you grant us a limited, non-exclusive license to process your Content solely for the purpose of providing the Service (generating responses, designing CRISPR guides, etc.). We do not claim ownership of your inputs or outputs.

We do not use your Content for model training, fine-tuning, or any purpose beyond generating your immediate response.

5. AI-Generated Content

Content generated by BioLLM is produced by an artificial intelligence system and may be inaccurate, incomplete, biased, or misleading. You acknowledge that:

  1. AI outputs are not verified by human reviewers before delivery;
  2. The Service may produce content that is factually incorrect;
  3. Neural Data (C-Score, brain regions, modulators) represents output from a computational simulation, not measurements from a conscious or sentient system;
  4. You are solely responsible for evaluating and verifying any AI-generated content before acting upon it;
  5. AI outputs do not constitute professional advice of any kind (medical, legal, financial, scientific, or otherwise).

6. OpenCure & Genomic Data

If you use the OpenCure CRISPR guide design tool, the following additional terms apply:

  1. Genomic Data is your sole responsibility. You are responsible for the security and handling of your genetic information. Do not upload Genomic Data on shared or public computers.
  2. Client-side processing. In Genome Chat mode, your VCF file is parsed entirely in your browser and is not transmitted to our servers. When you opt into CRISPR guide design, your VCF is transmitted via HTTPS, processed, and deleted immediately after pipeline completion.
  3. Research purposes only. CRISPR guide designs, variant annotations, and therapeutic construct suggestions are computationally generated and have not been experimentally validated. They must not be used for clinical diagnosis, treatment, or therapeutic decision-making without independent validation by qualified professionals and institutional review (IRB/IBC) approval.
  4. No sale or sharing. We will never sell, license, or share your Genomic Data with insurance companies, employers, law enforcement, or any third party.
  5. Risk acknowledgment. Genomic analysis may reveal information about elevated disease risk, carrier status, or other sensitive health-related findings. You accept this risk voluntarily.

7. Payments & Subscriptions

  1. Free tier. The Service offers 5 free messages per day per IP address without a wallet connection.
  2. Per-message pricing. After the free tier, chat messages cost $0.005 USD equivalent, payable in SOL, USDC, or $BioLLM tokens on the Solana blockchain.
  3. Subscriptions. Subscription plans (7-day, 30-day, 90-day) provide unlimited chat access for the purchased duration. Subscriptions are activated upon on-chain payment verification.
  4. Non-refundable. All blockchain transactions are final. Due to the nature of cryptocurrency payments, we cannot issue refunds. If the Service fails to deliver a response after payment, the amount is automatically credited to your wallet balance.
  5. Price changes. We reserve the right to modify pricing at any time. Changes do not affect active subscriptions.

8. Token Disclaimer

$BioLLM is an experimental utility token. It is not a security, investment contract, or financial instrument. The token provides utility within the BioLLM ecosystem (paying for chat messages and subscriptions). Its market value can fluctuate and may go to zero. Nothing in this Agreement or on the Service constitutes investment advice, a solicitation to purchase, or a recommendation to hold the token. You should consult a qualified financial advisor before purchasing any cryptocurrency.

9. Prohibited Conduct

You agree not to:

  1. Use the Service for any unlawful purpose or in violation of any applicable law or regulation;
  2. Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or that infringes on the rights of others;
  3. Attempt to extract, scrape, or systematically download model outputs, training data, or brain simulation parameters;
  4. Circumvent rate limits, authentication mechanisms, or access controls;
  5. Impersonate any person or entity, or falsely represent your affiliation;
  6. Introduce viruses, malware, or other harmful code;
  7. Use the Service to generate content for disinformation, fraud, or manipulation;
  8. Use OpenCure outputs for unauthorized human gene editing, germline modification, or any application that violates applicable biosafety regulations;
  9. Use automated systems (bots, scrapers, scripts) to access the Service beyond documented API rate limits.

10. Intellectual Property

The Service, including its software, design, algorithms, model weights, brain simulation, documentation, and all related intellectual property, is owned by Stormy IT Services LLC and protected by copyright, trade secret, and other intellectual property laws. This Agreement does not transfer any ownership rights to you.

Open source components used in the Service retain their respective licenses (Apache 2.0 for Qwen, vLLM, and OpenCure pipeline). These licenses govern your use of those specific components only.

11. Privacy & Data Collection

Our data handling practices are described in detail on our Transparency & Compliance page, which is incorporated into this Agreement by reference. Key points:

12. Disclaimer of Warranties

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WITHOUT LIMITATION, WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, OR COMPLETENESS.

WE DO NOT WARRANT THAT (A) THE SERVICE WILL MEET YOUR REQUIREMENTS; (B) THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM THE SERVICE WILL BE ACCURATE OR RELIABLE; (D) THE QUALITY OF ANY CONTENT OR NEURAL DATA WILL MEET YOUR EXPECTATIONS; OR (E) ANY ERRORS IN THE SERVICE WILL BE CORRECTED.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL STORMY IT SERVICES LLC, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, SUCCESSORS, OR ASSIGNS BE LIABLE FOR:

  1. ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES;
  2. ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, HEALTH, OR USE;
  3. ANY DAMAGES ARISING FROM RELIANCE ON AI-GENERATED CONTENT, CRISPR GUIDE DESIGNS, OR GENOMIC ANALYSIS;
  4. ANY DAMAGES ARISING FROM UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA;
  5. ANY DAMAGES ARISING FROM THE CONDUCT OF ANY THIRD PARTY ON THE SERVICE;

WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100 USD).

14. Indemnification

You agree to indemnify, defend, and hold harmless Stormy IT Services LLC and its officers, directors, employees, agents, and affiliates from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or related to: (a) your use of the Service; (b) your Content; (c) your violation of this Agreement; (d) your violation of any applicable law or regulation; or (e) your violation of any rights of a third party, including intellectual property rights.

15. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your license to use the Service immediately ceases. Sections 10 through 18 of this Agreement shall survive termination.

You may stop using the Service at any time. If you have an active subscription, no pro-rata refund will be issued for unused time.

16. Modifications to the Service & Terms

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time without notice. We reserve the right to update this Agreement at any time. Material changes will be indicated by updating the "Last updated" date at the top of this page. Your continued use of the Service after any modification constitutes acceptance of the revised terms.

17. Governing Law & Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any dispute, claim, or controversy arising out of or relating to this Agreement or the Service shall first be attempted to be resolved through good-faith negotiation. If negotiation fails, any legal action shall be brought exclusively in the state or federal courts located in Florida, and you consent to the personal jurisdiction of such courts.

CLASS ACTION WAIVER: You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
